Non-Commercial Use

This Site and products sold through this Site are intended solely for the personal, non-commercial use of our customers and our potential customers. Our products are not being offered for re-sale unless previous, written authorization has been provided.

Product Pricing, Availability, & Accuracy

Prices and availability of products and services are subject to change without notice. Errors will be corrected where discovered, and H/H/F/F reserves the right to revoke any stated offer and to correct any errors, inaccuracies or omissions including after an order has been submitted and whether or not the order has been confirmed and your credit card charged.

Returns

Every item is carefully inspected before leaving our studio. H/H/F/F does not accept returns for any reason other than defect. 

In the event that damage occurs in transit, or if you discover any defect in manufacturing please email us within 7 days of delivery at howdy@happyhappyfun.fun with your customer information. All returns must be pre-authorized.

H/H/F/F will arrange return shipping. Customer is responsible for return shipping charges + 30% restocking fee apply for all returns and exchanges and are the customers responsibility no matter the reason for the return. H/H/F/F will inspect the product before the refund is issued.

Product Disclaimer

Products made by H/H/F/F are vintage and hand crafted, meaning minor blemishes and imperfections may be visible. These are not considered defects and do not interfere with the quality and function of the product. 

H/H/F/F attempts to display product images shown on the site as accurately as possible. However, we cannot guarantee that the color you see matches the product color, as the display of the color depends, in part, upon the monitor you are using.

H/H/F/F Warranty

H/H/F/F guarantees that all products sold from our facilities are free from manufacturing faults and defects at the point of original delivery. We guarantee the materials used to construct our products for a period of 90 days from that date. In the event that a product is proven to be defective, you are entitled to the restoration of the goods through repair or replacement, whichever is decided as being the most efficient and effective remedy. 

The warranty does NOT cover:

- Degradation of finish caused by environmental factors.

- Any breakage or damage caused by negligent and/or improper use of the goods.

- Changes caused by normal wear and tear.

- Any damage caused by lack of and/or erroneous maintenance.

ANY DEFECTS MUST BE REPORTED IMMEDIATELY WITH SUPPORTING PHOTOS.

Copyrights and Copyright Agents

Happy Happy Fun Fun, Ltd. respects the intellectual property of others, and we ask you to do the same. If you believe that your work has been copied in a way that constitutes copyright infringement, please provide our Copyright Agent the following information:

1. An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest;

2. A description of the copyrighted work that you claim has been infringed;

3. A description of where the material that you claim is infringing is located on the Site;

4. Your address, telephone number, and email address;

5. A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and

6. A statement by you, made under penalty of perjury, that the above information in your Notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

Miscellaneous

This Agreement shall be treated as though it were executed and performed in Denver, Colorado, and shall be governed by and construed in accordance with the laws of the State of Colorado (without regard to conflict of law principles). Any cause of action by you with respect to the Site (and/or any information, Documents, products or services related thereto) must be instituted within one(1) year after the cause of action arose or be forever waived and barred. The language in this Agreement shall be interpreted as to its fair meaning and not strictly for or against any party. This Agreement and all incorporated agreements and your information may be automatically assigned by Happy Happy Fun Fun, Ltd. in our sole discretion to a third party in the event of an acquisition, sale or merger. Should any part of this Agreement be held invalid or unenforceable, that portion shall be construed consistent with applicable law and the remaining portions shall remain in full force and effect. To the extent that anything in or associated with the Site is in conflict or inconsistent with this Agreement, this Agreement shall take precedence. Our failure to enforce any provision of this Agreement shall not be deemed a waiver of such provision nor of the right to enforce such provision. Our rights under this Agreement shall survive any termination of this Agreement.
